KelseyJFit Terms of Use

Last Updated: Oct 7, 2026

KelseyJFit is operated by Kelsey Johnston, operating as KelseyJFit, a Wisconsin sole proprietorship (“KelseyJFit,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern the KelseyJFit fitness service, including its iOS app, account, workout programs, exercise videos, progress tools, and related support (the “Service”).

These Terms govern the KelseyJFit service and business relationship in addition to the applicable iOS software license. They are not intended as a custom Apple end user license agreement. Apple’s Standard End User License Agreement (“Apple Standard EULA”) applies when no alternative license is made applicable through the App Store, as explained in Section 21.

1. Acceptance of These Terms

By creating an account or using the Service, you agree to these Terms and acknowledge the KelseyJFit Privacy Policy. If you do not agree, do not use the Service. To create an account, you must affirm that you meet the age requirements in Section 2 and agree to the Terms and Privacy Policy. Acknowledging a privacy policy does not replace any separate consent required by law.

The Privacy Policy describes how we handle personal information. Purchase terms displayed by Apple apply to your subscription. Nothing in these Terms limits privacy rights or other protections that applicable law does not allow you to waive.

2. Eligibility and Geographic Scope

You must be at least 18 years old to create an account or use the Service. If you reside in Canada, you must also have reached the age of majority in your province or territory of residence (18 or 19, as applicable). Accounts are for individual adults, not children or minors. You must have authority to enter into these Terms and provide accurate account information.

The Service is offered for use by users in the United States and Canada, subject to availability in the applicable App Store storefront. The current app is available for iOS. Temporary travel or technical access from elsewhere does not mean we offer the Service in other countries.

3. What the Service Provides

KelseyJFit provides fitness programs for gym, home, and hybrid training, exercise demonstration videos, workout logging and history, and optional progress tracking. You can record exercise sets, repetitions and loads, body weight, waist/hip/arm/leg measurements, and front/side/back progress photos. Program schedules, workout completion history, prior performance, and photo comparisons help you review your training.

The app provides general fitness content. A subscription does not include individualized medical care, injury assessment, live supervision, or one-to-one coaching. Any separately purchased coaching service is governed by its own arrangements and is not included merely because you subscribe to the app.

Exercise demonstrations are delivered through Cloudflare Stream. Programs and available content may change as described in Section 16. The Service does not promise a particular exercise, program, or video will remain available indefinitely.

4. Accounts and Security

Register using your name, email address, and password, and complete the required email verification. Keep your information current, safeguard your password and device, and do not share your account credentials. You are responsible for activity you authorize through your account; notify us promptly if you suspect unauthorized access.

Do not impersonate another person, create an account for a minor, provide another person’s information without permission, or use another member’s account. Use the account and Apple purchase account associated with your subscription to avoid access and restoration problems.

Email verification and password-reset codes are sent to your account email. Keep access to that email and never disclose verification codes to someone claiming to need them for support.

5. Subscriptions, Billing, and Cancellation

5.1 Paid Access

Paid access is offered through monthly and annual auto-renewing Apple App Store subscriptions. RevenueCat supports the paywall, purchase verification, and access entitlement. Review the price, currency, billing period, applicable taxes, and any offer conditions displayed in the Apple purchase flow before you authorize payment. Prices may differ between the U.S. and Canadian storefronts; the price and currency shown for your purchase apply.

5.2 Apple Auto-Renewal

Payment is charged to your Apple Account under Apple’s terms. Your subscription renews automatically for successive subscription periods at the applicable renewal price until you cancel through Apple. Apple may charge for renewal within 24 hours before the next period begins, so cancel before that charge is processed to avoid renewal. Removing the app, stopping use, or deleting your KelseyJFit account does not cancel an Apple subscription.

5.3 Restoring Purchases

Use Restore Purchases in Profile or on the paywall when you need to restore an eligible Apple purchase. Restoration depends on the Apple Account used for the original purchase and the purchase remaining valid.

If you restore the same purchase to a different KelseyJFit account, the subscription entitlement transfers to that account rather than creating a second entitlement. This does not transfer the original account’s workouts, progress photos, weight, measurements, or other history.

5.4 Trials and Promotional Offers

A trial, introductory price, or other promotion applies only if it is offered to you and you accept the terms shown at checkout. Eligibility, duration, and subsequent price are displayed by Apple. To avoid being charged after a free or discounted trial, cancel through Apple at least 24 hours before the trial ends. We do not promise that any trial or promotion is available.

5.5 Managing, Canceling, and Refunds

Manage or cancel your subscription in iPhone Settings under your Apple Account’s Subscriptions, or through Apple’s subscriptions page: https://apps.apple.com/account/subscriptions. Cancellation prevents future renewal when completed in accordance with Apple’s requirements. Access generally continues through the remaining paid period; trial access and refunds may be handled differently under Apple’s terms.

Apple processes App Store refund requests. Request an eligible refund at https://reportaproblem.apple.com/. Apple determines eligibility under its rules and applicable law. KelseyJFit cannot cancel an Apple subscription on your behalf or guarantee an Apple refund. Nothing here excludes a refund or other remedy required by law. Canadian consumers retain any cancellation, refund, and other remedies provided by applicable provincial or territorial law. Apple's refund process does not replace any obligation KelseyJFit owes you under those laws. Contact support@kelseyjfit.com to exercise a statutory right against KelseyJFit; separately manage or cancel Apple subscription renewal to prevent future billing.

5.6 Price and Subscription Changes

Any renewal-price change is subject to Apple’s notice and consent requirements and applicable law. Review notices from Apple and cancel before renewal if you do not wish to continue at the new price. We will not charge your payment card separately for the app subscription.

5.7 Purchase and Access Issues

Contact us if a valid purchase does not unlock access after restoring it. Do not buy another subscription solely to resolve an access problem without first checking your Apple subscriptions and restoration options. Billing disputes, purchase restrictions, and Apple Account issues may require Apple’s assistance.

6. Fitness Risks and Health Information

6.1 General Fitness Information

The Service provides general educational fitness information, not medical advice, diagnosis, treatment, physical therapy, or an individualized exercise prescription. Use of the app does not establish a healthcare-provider relationship. Information in a workout or video is not a substitute for professional advice about your own condition.

6.2 Determining Whether Exercise Is Appropriate

You are responsible for deciding, with appropriate professional guidance, whether an exercise or program is suitable for you. Consult a qualified healthcare professional before beginning or changing exercise when you have a medical condition, injury, symptoms, pregnancy or postpartum considerations, or uncertainty about safe participation. Do not disregard medical advice or delay seeking care because of app content.

6.3 Exercise Risks

Physical exercise carries risks, including falls, strains, sprains, overexertion, equipment-related injuries, serious injury, and, in some circumstances, death. Risk can increase with heavy loads, unfamiliar movements, inadequate recovery, and high-intensity techniques. Choose activities and loads appropriate to your ability and current condition. Your decision to participate is voluntary. This explanation of risk does not waive any claim or protection that cannot lawfully be waived.

6.4 Safe Participation

  • Learn proper technique, warm up appropriately, and progress gradually.

  • Use suitable equipment, inspect it, and follow the manufacturer’s safety instructions.

  • Use a competent spotter or qualified supervision when needed, especially for heavy lifts or techniques approaching muscular failure.

  • Do not treat instructions such as “failure,” “forced reps,” or similar intensity cues as directions to continue through pain, unsafe technique, dizziness, or exhaustion.

  • Modify or skip an exercise if you cannot perform it safely, and allow appropriate rest and recovery.

6.5 Stop and Seek Help

Stop exercising if you experience chest pain, faintness, severe shortness of breath, unusual pain, or other concerning symptoms. Seek appropriate medical assistance; call 911 for an emergency in the United States or Canada, where available, or contact the applicable local emergency service. The Service does not monitor you or provide emergency response.

6.6 No Guaranteed Results

Results vary with health, experience, consistency, recovery, and other factors. We do not guarantee weight loss, muscle gain, a particular appearance, improved health, or any other result. Progress calculations and historical comparisons are informational and may contain errors; they are not clinical assessments.

7. KelseyJFit Content and Intellectual Property

KelseyJFit and its licensors retain ownership of the workout programs, exercise descriptions, videos, graphics, branding, and other Service content, except your own content. Subject to these Terms and a valid entitlement where required, you may access this content for your personal, noncommercial fitness use. The applicable iOS software license is separate, as described in Section 21.

Without permission or a right provided by law, you may not:

  • Copy, sell, redistribute, publicly perform, or commercially exploit programs or videos.

  • Record or download protected videos through unauthorized tools.

  • Share paid access, credentials, or protected media links.

  • Remove ownership notices or bypass access restrictions.

  • Use Service content to create a competing content library or train an artificial intelligence system.

Nothing transfers ownership of Service content to you. Statutory rights that cannot be restricted remain unaffected.

8. Your Progress Photos and Other Content

You retain ownership of the photos and other information you submit. You grant KelseyJFit a limited, nonexclusive right to host, store, reproduce, format, transmit, and display that content only as reasonably necessary to provide the features you request, protect and support the Service, and meet applicable legal obligations, subject to the Privacy Policy. We may use service providers for these purposes under appropriate restrictions.

This permission does not authorize selling your photos, using them in advertising or testimonials, or publishing them for other members. It lasts only as needed for the permitted purposes and applicable retention described in the Privacy Policy; it does not override a valid deletion request or a legally required consent.

Upload only your own lawful progress photos and information you are entitled to provide. Do not include another person’s private information or images without permission, or submit unlawful or exploitative content. Photos, weight, and measurements are optional.

Your progress is not a public profile or social feed. Kelsey and other admins cannot view members’ personal progress through the content-management dashboard. Authorized personnel and service providers may access relevant records, including photos, only for permitted operational, support, security, or legal purposes described in the Privacy Policy.

9. Privacy and Communications

The KelseyJFit Privacy Policy explains collection, use, service-provider access, retention, and your choices and rights. Please review it before providing personal information, particularly progress photos and fitness information.

The app sends account-verification and password-reset emails. After onboarding, the app asks for notification permission. If you allow notifications, we send new-program announcements. You can decline notifications or disable them in iOS Settings. We may also respond to support or privacy requests and provide necessary notices. The current app does not provide workout-reminder notifications or marketing email campaigns. Do not send payment-card details, passwords, or verification codes to our support address.

10. Third-Party Services

The Service uses providers for account hosting, subscriptions, video delivery, authentication email, app operation, and crash reporting. The Privacy Policy identifies these providers and explains how they handle personal information.

Apple purchases and any services you access independently are also subject to the relevant provider’s terms. A link does not mean that we control the third-party site. This section does not relieve KelseyJFit of obligations for its own Service or its handling of your information.

11. Prohibited Uses

You must not:

  • Use the Service unlawfully, fraudulently, or to infringe another person’s rights.

  • Attempt to access another person’s account, photos, fitness records, or restricted systems.

  • Bypass subscriptions, security measures, or content-access controls.

  • Introduce malware, disrupt the Service, or impose unreasonable automated traffic.

  • Scrape, harvest, or collect other users’ information.

  • Misrepresent your identity, age, purchase status, or affiliation.

  • Threaten, harass, or abuse anyone in connection with the Service.

  • Reverse engineer or exploit the Service except where applicable law permits it despite a contractual restriction.

12. Suspension and Termination

We may restrict or suspend access for a material breach of these Terms, fraud, security risks, unlawful activity, or legal requirements. Where reasonably practicable, we will explain the reason and allow you to address the issue; urgent or legally restricted situations may require action without advance notice.

You may stop using the Service or delete your account. Suspension or termination does not itself stop Apple billing. Manage or cancel your Apple subscription separately. Refund rights under Apple’s rules and applicable law remain unaffected.

Terms that by their nature should continue, including ownership, valid accrued payment obligations, and lawful limitations and dispute provisions, survive termination. Personal information remains subject to the Privacy Policy and applicable deletion rights.

13. Account Deletion Is Separate from Subscription Cancellation

You can initiate account deletion within the app from Profile or the locked paywall screen, including without an active subscription. Follow the confirmation instructions, including typing DELETE. Contact us if you cannot access the deletion function.

Successful account deletion removes your account and profile, workout history and exercise logs, weight and measurements, progress photos, program selections, and associated notification information from KelseyJFit’s active systems. You are then signed out. If deletion fails or the app reports an error, retry or contact support. Restoring a subscription does not restore deleted training history or photos.

When you delete your account, KelseyJFit requests deletion of your associated RevenueCat customer record. Processing by RevenueCat may finish later. Limited subscription, security, and other operational records or provider backup copies may remain as described in the Privacy Policy and subject to applicable deletion rights.

Deleting your account does not cancel your Apple subscription. To prevent future renewal, cancel separately through Apple: https://apps.apple.com/account/subscriptions. You may delete your account immediately without waiting for the subscription to expire.

14. Reporting Intellectual Property Concerns

If you believe Service content infringes your rights, contact us with your name, contact details, a description of the protected work, the location of the challenged content, and an explanation of your rights and concern. Provide enough information for us to investigate. We may remove or restrict disputed content as appropriate without prejudging either party’s legal rights.

15. Feedback

If you voluntarily provide suggestions about the Service, you permit us to use those suggestions to improve it without compensation or an obligation of confidentiality, unless we agree otherwise. This provision does not authorize publishing personal information, progress photos, or fitness records, and does not limit your rights under the Privacy Policy.

16. Availability and Service Changes

We use reasonable efforts to operate the Service but cannot guarantee continuous availability or error-free operation. Maintenance, network problems, provider outages, device compatibility, and updates may affect access. You are responsible for a compatible device and internet connection.

We may update programs, features, and technical requirements. For a material reduction or discontinuation affecting a paid subscription, we will provide reasonable notice where practicable and respect applicable consumer remedies and Apple’s rules. We will not use this section to deny nonwaivable rights or retain payments unlawfully. For Canadian consumers, changes and discontinuation remain subject to mandatory notice, consent, cancellation, and refund requirements. This section does not authorize a unilateral change to an essential contract term where prohibited by law.

17. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement to the extent those warranties can lawfully be disclaimed. We do not warrant that all content is complete, accurate, available, or suitable for your individual needs.

These service disclaimers do not alter the applicable iOS software license, exclude an express commitment we make to you, or limit a statutory guarantee or remedy that cannot be excluded. Some limitations may not apply to you. For Canadian consumers, statutory warranties, conditions, and consumer remedies that cannot lawfully be excluded continue to apply. For consumers in Quebec, the disclaimers in this section do not apply to the extent they would exclude or limit responsibility for KelseyJFit's own acts or those of its representatives.

18. Limitation of Liability

To the extent permitted by law, KelseyJFit will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the Service, including lost profits or loss of opportunity. Subject to the exceptions below, our aggregate liability arising from the Service will not exceed the greater of US$100 (or its equivalent in your payment currency) or the amount you paid for the Service during the 12 months before the event giving rise to the claim.

These limitations do not apply to death or personal injury caused by our negligence, gross negligence, willful misconduct, fraud, or liabilities or remedies that applicable law does not allow us to limit. They do not restrict your privacy rights, required refunds, or the applicable iOS software license’s operation. Nothing excuses our failure to comply with applicable data-protection law. For consumers in Quebec, the exclusions and liability cap in this section do not apply to the consequences of KelseyJFit's own acts or those of its representatives. For other Canadian consumers, these limitations apply only to the extent permitted by the mandatory laws of their province or territory.

19. Responsibility for Third-Party Claims

To the extent permitted by law, you agree to indemnify KelseyJFit for reasonable losses and expenses, including reasonable attorney fees, resulting from a third-party claim caused by your unlawful conduct, knowing infringement of another person’s rights, or material breach of these Terms. This does not apply to claims caused by KelseyJFit’s negligence, misconduct, or breach of law. The contractual indemnification obligation in this section does not apply to consumers residing in Quebec; any responsibility they have for unlawful conduct is determined by applicable law.

We will give reasonably prompt notice of a covered claim and a reasonable opportunity to participate in its defense. No settlement may impose an admission, payment, or continuing obligation on you without your consent, which will not be unreasonably withheld.

20. Governing Law and Disputes

For consumers residing in Quebec, these service Terms are governed by the laws of Quebec and the federal laws of Canada applicable there. For other users, Wisconsin law governs these service Terms, without its conflict-of-law rules, but does not deprive you of mandatory protections under the laws of your province, territory, or other place of residence. This section does not change the governing-law or dispute provisions of the applicable iOS software license for matters that agreement governs.

Please contact us about a dispute so we can try to resolve it. Informal contact is encouraged, not a mandatory delay or a restriction on filing a claim. Disputes may be brought in a court with jurisdiction under applicable law, including an eligible small-claims court. These Terms do not impose mandatory arbitration or a class-action waiver. Canadian consumers may bring claims before the courts of their province or territory where applicable law permits; these Terms do not require them to bring a claim in Wisconsin.

21. Apple Standard EULA and Apple Terms

The iOS application is licensed under the license agreement applicable to it through the App Store. Where no alternative license agreement is made applicable, Apple’s Standard EULA applies. These service Terms are separate from that software license and are not intended as a custom Apple EULA. On a matter governed by the applicable software license, that license controls any conflict with these service Terms.

Apple’s applicable media-services, purchase, and subscription terms also apply to your Apple Account and App Store transactions. These Terms do not change Apple’s obligations, remedies, or billing rules. KelseyJFit is responsible for its Service; Apple does not provide our workout programs, fitness advice, or member support.

22. General Provisions

These Terms and the applicable purchase terms describe the service agreement between you and KelseyJFit, subject to the applicable iOS software license and nonwaivable law. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision is not a waiver.

You may not transfer your account or these Terms without our consent except as permitted by law. We may transfer the Service and these Terms as part of a lawful business transfer, provided this does not diminish your nonwaivable rights and personal information remains protected as described in the Privacy Policy.

23. Changes to These Terms

We may revise these Terms and will update the date above. For material changes, we will provide appropriate notice and obtain agreement where required by law. Changes will apply prospectively and will not retroactively remove accrued rights. If you do not agree to revised Terms, stop using the Service and cancel any renewal through Apple; applicable refund and other legal rights remain available. For Canadian consumers, no change overrides mandatory provincial or territorial notice, consent, cancellation, or refund rights. For consumers in Quebec, this section does not grant us a right to amend an existing contract unilaterally; changes to that contract require your agreement unless otherwise permitted by law. Refusing a proposed change does not waive your rights under the existing contract.
